Case Background: Ms. Z is one of previous client, and her whole family became Canadian PR in August 2019. In February 2019, Miss Z applied to the Department of Civil Affairs in China to adopt an orphan (born in 2017) from a local orphanage. After a series of administrative procedures, the adoption certificate was issued in November 2019. Ms Z and her family returned to China 10 days after they became Canadian landed immigrants as she worried about wellbeing of the newly adopted baby. Ms Z. had to go back to Canada as her biological daughter was starting her school in March 2020. She left the adopted baby to her husband before coming to us to handle the sponsorship application.
Application Process: After detailed, careful preparation, in June 2020, we helped our clients submit the sponsorship application. In February 2021, the sponsor is approved and half month later the medical examination notice was received. Something unexpected happened in March 2021 as the Ministry of Children and Family Development sent an email requiring details to support that the child was adopted before Ms Z became Canadian PR. We took immediate actions to help the clients prepare all necessary documents for the Ministry of Children and Family Development. In April 2021, the Ministry sent the Letter of No Involvement to the IRCC, declaring no involvement as it was domestic adoption in China. Things did not got better as the IRCC requests more supporting documents, including the complete evidence of the logistic behind the entire adoption process, Certified English translation of the family background documents, Canadian family background check, and provincial approval of the adoption from the BC government. In response to the third supplement documents request, we communicated with the BC government to reconfirm its positive opinion on the genuineness of the adoption to IRCC. At the same time, we attached a detailed and compelling explanation letter to IRCC, emphasizing that due to the long-term separation, both the sponsor and the adopted child had been emotionally tortured. Background check phone calls were received from the IRCC by the orphanage, Civil affairs department, and sponsor’s family. In September 2021, the sponsor finally received a phone call from the Canadian Embassy in Beijing, telling her that her application was about to be approved. After another two months, a confirmation of domestic adoption was approved on December 1st 2021. Shortly after that, the request for passport was received. On December 16th, the immigration visa was issued.
Case Summary It is not easy for children adopted in China to apply for family sponsorship. Even though the IRCC experienced a serious backlog of applications during the epidemic, it such applications are still treated with extra care. It has been quite a struggle to prove the legitimacy of the adoption. Therefore, it is necessary to have sufficient care, patience and perseverance in the application process to ensure that everything starts from the facts without any omissions in order to have the application approved.
